called the Regular Planning Board Meeting to order at 7:05 pm, at the Town of
Yates, 8 S. Main Street, Lyndonville, NY 14098.

MINUTES:
Chairman Donald Lamay entertained a motion to accept the minutes from the January 6, 2011 meeting.
RESOLUTION NO. 2-02/11
RESOLUTION TO ACCEPT THE MEETING MINUTES FROM THE JANUARY 6, 2011 MEETING AS PRESENTED TO EACH BOARD MEMBER.
RESOLVED, to accept the meeting minutes from January 6, 2011 as presented to each Board Member.

Chairman Donald Lamay opened the meeting discussing Brandon Aukers Special Use Permit to open a Farm Market to sell produce and meat products (cut up meat).
Some questions were asked (1) How many people will be working? (2) Will there be any slaughtering? (3) What about waste disposal?
Dan Wolfe said that it was going to be Brandon and his wife and that there will be no slaughtering done there.
Chairman Donald Lamay entertained a motion to accept Brandon Aukers Special Use Permit Application for a farm market to sell produce and meat products (cut up meat) with stipulations. To have appropriate documents and proper waste disposal.
RESOLUTION NO. 3-02/11
RESOLUTION TO ACCEPT BRANDON AUKERS SPECIAL USE PERMIT APPLICATION FOR A FARM MARKET TO SELL PRODUCE AND MEAT PRODUCTS (CUT UP MEAT) WITH STIPULATIONS. TO HAVE APPROPRIATE DOCUMENTS AND PROPER WASTE DISPOSAL.

John Heveron came to the Planning Board with a concern he has with his land at the lake. There is 150 ft. right away. There are 7 to 10 cottages down there that have access to the water. John owns the vacant property on both sides of the right away. He does maintain the property. The cottagers feel that they can do whatever they want on the property. He can’t sell or build on it. He feels that if he tells the cottagers to stay off the property that they will take him to court.
Dan Wolfe said it’s a private property matter.
The Planning Board gave John an option – divide the land into 2 nonconforming lots with 20 ft. right a ways. Then bring it to the Zoning Board.
Steve Freeman suggested John use a better map to present it to the Zoning Board.
Next the Planning Board discussed the submitted Special Use Permit application from Mark Zimmerman for a Section 740 Home Business to open a greenhouse. Mark bought Kevin Brubackers greenhouse to run as his own business.
The Planning Board looked over his site plan. He has more than enough land to use. Plenty of room for parking if needed.
The Planning Board suggested that the business should be Section 741 Home Business B. Dan Wolfe is going to run it by Mark to see if he would like to change it. If Mark says yes then he will reapply and get a variance.
Chairman Donald Lamay welcomed Wes Bradley to our meeting.
Chairman Donald Lamay asked Wes if the camper issue has been discussed with the Town Board yet.
Wes said that it was his understanding that it would be discussed on Monday (February 7) during the work shop.
Chairman Donald Lamay asked what Kevin Brubacker was doing with his bakery.
Dan Wolfe said that he is going to expand his bakery and is applying for a Special Use Permit for a Home Business B.
Dan Wolfe also mentioned to the Planning Board that Kenneth Martin wants to build and sell Amish style sheds. Dan is going to have Kenneth fill out the Special Use Permit and bring it back to next month’s meeting.
The Planning Board then discussed Jeff Johnsons Special Use Permit. There should be a stipulation on his updated Special Use Permit. The tanks should have foundations. In case of leaks or a break they need to be contained. It was suggested that a list of questions we have be given to Jeff for next month’s meeting. We will have him come in and go over the questions with us.
Gary Daum went to the County Planning Board meeting. The upcoming Training seminar was mentioned. It will be June 28, 2011in Albion. It will be a 4 hour session. Also FEMA is still looking into doing new risk maps. They are going to concentrate 1st on Towns along the lakeshore.
The Planning Board has decided to have a joint meeting with the Zoning Board next month.
