called the Regular Planning Board Meeting to order at 7:00 pm, at the Town of
Yates, 8 S. Main Street, Lyndonville, NY 14098.

MINUTES:
Chairman Donald Lamay entertained a motion to accept the minutes from the March 7, 2013 meeting.
RESOLUTION NO. 6-5/13
RESOLUTION TO ACCEPT THE MEETING MINUTES FROM THE MARCH 7, 2013 MEETING AS PRESENTED TO EACH BOARD MEMBER.
RESOLVED, to accept the meeting minutes from March 7, 2013 as presented to each Board Member.

Due to the lack of an agenda there was no Planning Board meeting in April.
Harrold Suhr the owner of the White Birch Golf Course came in to talk about the parking situation there.
Harrold Suhr - Trying to buy land, I’m land locked right now. Been trying for years to buy land, no one seems to want to sell.
Dan Wolfe – When you have a big activity do they park neatly?
Harrold Suhr – No. Until I get it black topped, then I can mark lines for parking. I’m all for a solution, I don’t want to have to close my business.
Next the planning board discussed Marlin Yoder’s Special Use Permit for a dog kennel.
Dan Wolfe said that the Zoning Board did grant the variance for Marlin Yoder.
Chairman Donald Lamay read an e-mail from a concerned Town of Yates resident regarding Mr. Yoder running a “puppy mill”.
Marlin has 8.95 acres now but is in the process of getting another 6.5 acres from his father. He will then have more than enough land for the dogs.
Chairman Donald Lamay let Mr. Yoder know that the Planning Board will need to review the Zoning Variance that he got and will be put with the Special Use Permit application.
Chairman Donald Lamay entertained a motion to have a public hearing next month for Marlin Yoder.

RESOLUTION TO HAVE PUBLIC HEARING FOR MARLIN YODER
RESOLVED, to have public hearing for Marlin Yoder.

Mr. Yoder let the board know that he will be working with the vet very closely and will be doing what the vet says. The dogs will be kept clean and healthy. You don’t know when the USDA is coming but they do come once a year to inspect unless there is an issue.
Dan Wolfe asked what Mr. Yoder’s goal was for 2 years.
Mr. Yoder – Not planning on having more than I can handle. If it’s going good he plans on building a bigger barn in the back for more room. Still plans on only selling to pet stores.
Next Chairman Donald Lamay asked Dan Wolfe if there was anything new with the SEQR forms.
Dan Wolfe – No not yet
Chairman Donald Lamay briefly went over the penal law of disorderly conduct at meetings and mentioned the training coming up. If anyone is interested to see Dawn.
