called the Regular Planning Board Meeting to order at 7:10 pm, at the Town of
Yates, 8 S. Main Street, Lyndonville, NY 14098.

MINUTES:
Chairman Donald Lamay entertained a motion to accept the minutes from the June 6, 2013 meeting.
RESOLUTION NO. 11-7/13
RESOLUTION TO ACCEPT THE MEETING MINUTES FROM THE JUNE 6, 2013 MEETING AS PRESENTED TO EACH BOARD MEMBER.
RESOLVED, to accept the meeting minutes from June 6, 2013 as presented to each Board Member.

Chairman Donald Lamay asked the board members if they had any questions regarding Mr. Albone’s special use permit application.
Where the pay loader is parked, will that be a problem?
Dan Wolfe mentioned that it is far enough from the road that it shouldn’t be a problem.
There were no other questions.
Chairman Donald Lamay spoke briefly about the 2 amendments that have been proposed to the Town Board. The application for Amendment to Zoning Text has been done. Also the new SEQR forms will be going into effect in October. The Town of Carlton is using a new one now.
The regular meeting adjourned for the public hearing at 7:28 pm.

This is special use permit application #03-13 submitted by Aaron Albone on Marshall Rd. for a Section 741 for steel sales.
Chairman Donald Lamay opened the floor up for any comments.
There were no comments from the floor.
Deputy Clerk Dawn Metty let the board know that Mrs. Maines came into the office and said that neither she or Mr. Maines have a problem and is fine with Mr. Albone having a business.
There was no opposition
Chairman Donald Lamay entertained a motion to close the public hearing.

Reconvene to the regular meeting
Richard Kurz recommended approval of Aaron Albone’s special use permit with the County’s recommendation. (See Attached)
RESOLUTION NO. 12-7/13
RESOLUTION TO APPROVE AARON ALBONE’S SPECIAL USE PERMIT WITH THE COUNTY’S RECOMMENDATION.
RESOLVED, to accept Aaron Albone’s special use permit with the County’s recommendation.
