Chairperson Sue Bane called the Regular Meeting to order at 7:00PM, at the Yates Town Hall, 8 South Main Street, Lyndonville, New York 14098.

Please
note: Wayne Townsend a neighbor of Paul
& Annette Mullane came into the Town Office on Friday September 14, 2012 to
review their application. He was
concerned thinking that it was the property right next to his but it was
actually 2 properties away from his. His
concern was that they might be too close to his property. He was fine with the variance after finding
out that it was 2 properties away.
Chairperson
Sue Bane asked that the word “front” be added to the variance. Instead of 12’ lake side setback, it is 12’
lake front side setback variance.
The
Zoning Board discussed Paul & Annette Mullane’s application for an area
variance.
Chairperson
Sue Bane, Donna Bane, and Paul Lauze went down to see the property.
The
Area Variance Findings & Decision form was filled out.

Sue Bane made a motion to adjourn the meeting for the public hearing at 7:30
pm.

The
following notice was placed in the Medina Journal Register on September 12,
2012.
PLEASE
TAKE NOTICE; there will be a Public Hearing held on September 18, 2012 at 7:30
pm at the Yates Town Hall, 8 South Main Street, Lyndonville, New York
14098. The purpose of the public hearing
is for an Area Variance, Application # 05-2012, submitted by Gregg Wendt on
behalf of Paul & Annette Mullane at 11359 Wescott Lane FL S2, Lyndonville,
New York 14098 for a 5ft. West Side SetbackVariance and a 12 ft. Lake Front Side Setback Variance. This application may be reviewed at the
Office of the Town Clerk, 8 South Main Street, Lyndonville, NY 14098 during
regular business hours.
All
persons wishing to be heard shall be heard at this time. Correspondence may be made in person at the
Public Hearing or by letter to the Town of Yates Zoning Board of Appeals.
This
is Application # 05-2012 for Paul & Annette Mullane requesting a 5 ft. west
side setback variance and a 12 ft. lake front side setback variance to build an
addition on to his cottage.
Chairperson
Sue Bane asked where the addition is going to be.
Paul
Mullane – Exactly where the deck is now.
He also confirmed that he does own both properties on each side of the
property he is asking the variance for.
Paul also stated that the family is growing and that
is why he wants to build an addition.
It
was asked if he was going up 1 or 2 stories.
Paul
Mullane – I haven’t decided yet, I’m still waiting for the pricing to come
back.
